Bus passenger awarded £6,000 in tripping claim

Mrs Brogan does not drive and uses the bus fairly regularly – probably around 3 or 4 times a week. On a warm day in June, Mrs Brogan was waiting for a bus to take her into the town centre. When stepping onto the bus, she tripped on a raised rivet in the floor and fell, injuring her leg.

She was immediately in a lot of pain and other passengers came to help her. Unfortunately the driver couldn’t as she had fallen right in front of his cab and he couldn’t get out.

Blood was pouring from a cut on her shin and a passing nurse helped. An ambulance was called and by the time it arrived, Mrs Brogan was shaking and felt sick. Paramedics dealt with the cut at the scene.

Just over a week later, and still in pain, Mrs Brogan went on a long arranged holiday to Spain with her family. Her symptoms got worse with the skin around the injured area starting to peel and scab. Her leg became red and swollen.

When she returned home the doctor told her that the bacteria from the rivet had infected the wound. Mrs Brogan was given antibiotics but, 6 weeks after the accident she was still in pain and an x-ray showed fluid on her leg. After further treatment and another course of antibiotics, she was still in a lot of pain and, following visits to the doctor and hospital, was diagnosed with cellulitis approximately 6 months after the accident.

The pain she was suffering was as a result of nerve damage due to the accident. It took around 8 months for the swelling to go down and the flaking of the skin to stop. Mrs Brogan still suffers from pain which causes some difficulty in household chores and shopping. She has suffered nightmares about the accident and now finds it impossible to travel by bus.

Providers of services such as buses have an obligation to ensure that their passengers are safe, and when they do not, they are likely to be liable for accidents and injuries. Lawyers for The Accident Team took up Mrs Brogan’s case and won compensation for her.
