When we hear about people falling down in bars its normally part of an amusing story, but this was definitely not the case for Ian Barnes of Peterborough, whose visit to the Albannach Whisky Bar/Restaurant near Trafalgar Square in London landed him in hospital with a broken back.

Ian runs his own business, E & C Barnes Courier Services, and so making a morning delivery to the bar was quite a routine thing for him in his job as a courier. However, today was different and what should have been a quick in and out visit, left him unable to make any more deliveries for 7 weeks – which is pretty devastating when you run and work in your own business.

Unaware that a trap door leading to the lift shaft had been left open, Ian approached the bar area to obtain a signature for the packages, but of course he didn’t make it and fell right through the open door. He suffered a broken back, a knee injury which was diagnosed as serious cruciate ligament damage to his knee; which required surgery.

Having already spent 9 months trying to gain some recompense for the injury and loss of work with the help of national firm, Shoosmiths Solicitors, Ian felt he was getting nowhere. Ian was delighted with the outcome, and whilst he was left with some scarring, he made a good recovery, and with the help of The Accident Team, got back to ‘business as usual’.

The occupier of premises has a duty to take any reasonable care required to prevent visitors to the premises suffering injury. This duty was breached as the trap door was left open and no warning signs were provided.
