Acceptance of Terms

By accessing or using the Website you agree to accept and be bound by all of the following terms and conditions set out herein.
You will not use the Website for any unlawful purpose or where you are prohibited from doing as under these Terms and Condition. If you do not agree to these Terms and Condition you must stop using the Website immediately.

You agree not to impersonate another person or use a false name or a name you are unauthorised to use or create a false identity or e-mail address or try to mislead others as to the identity or origin of any communications.

Unless specifically stated in these Terms and Condition you must refrain from the following unless you have prior written permission from an authorised member of staff at The Accident Team:

Interfere, damage or disrupt access to the Website or do anything that may interrupt or impair its functionality.

Publish, post, distribute, disseminate or otherwise transmit to the Website defamatory, offensive, infringing, obscene, indecent or other unlawful or objectionable material or information.

Make available, upload or distribute by any means any material or files that contain any viruses, bugs, corrupt data or any other harmful software to the Website.

The law outlined principally relates to England and Wales however the law in Scotland and Northern Ireland is usually similar and cases in those jurisdictions are always referred to a solicitor qualified in the relevant country. The Accident Team is not liable for any action taken by a user based on the content of the Website. You agree not to download any content where you are prohibited from doing under these Terms and Condition and not to copy, print, reproduce, transmit, store, sell or distribute any content of the Website without the prior written consent from an authorised member of staff at The Accident Team, save for personal, non-commercial purposes only.

We scan the internet regularly for any infringement of our copyright and will take legal action to the full extent permitted by law where we find our copyright is being infringed. We will also notify all search engines and directories of the violation and they are usually then blacklisted.

The Website contains links to other Internet Websites that are maintained and controlled by its owners. The links provided are for information purposes only and do not constitute an endorsement of any such Website and you agree that we are not responsible or liable for the content or availability of any such Websites.

The operation of the scheme

By submitting an enquiry form claim you agree that you will fully co-operate with The Accident Team, its employees, agents or other representatives.

You confirm that you have not instructed any other company or solicitor to act on your behalf on a claim that you submit to The Accident Team.

You agree that The Accident Team will refer your claim to one of its panel solicitors to assess your claim. There is no cost to you for this unless during the assessment period you choose to transfer your claim to another company or firm in which case you will incur an administration charge.

If you decide to withdraw the claim or instruct another company or firm after the claim has been accepted by our panel solicitors, you will be fully liable for all costs in pursuing the claim and liable to reimburse all costs that have been incurred.

You confirm that any information you present to The Accident Team is not exaggerated and is done so truthfully.

We comply with the Solicitors’ Introduction and Referral Code 1990. We have an arrangement with a firm of solicitors where we will introduce clients to them, and they pay us a fee for such referrals ranging between £0 and £550 depending on the nature of the claim. The firm will provide legal services to you, subject to a merits assessment of your case. We have the option to review the arrangement, including the level of fee and the number of referrals with the firm on a quarterly basis.

Any solicitor we refer you to is independent from us and will give you impartial and confidential advice. You are free to choose another solicitor. We make no charges to you for using the services of The Accident Team and our services to you are completely free. Our fee is paid separately by the firm and is NOT deducted from any compensation you may receive.


Availability of TheAccidentTeam Website

We provide the Website on an “as is” and “as available” basis only and you agree that the functionality or access to the Website may be subject to interruption or breakdown. The Accident Team makes no warranty that the Website or the server used to host the Website are free from viruses or anything else which may be harmful or destructive. However, we will make every attempt to correct any reported faults and/or errors as soon as possible. You agree that your use of the Website is at your sole risk.

In order to process a claim, it is necessary for The Accident Team to process information on their clients. You agree that your data may be held to enable us to answer questions relating to your claim. This data may be shared with or transferred to our panel solicitors or third parties (for example Counsel or expert witnesses) providing services in connection with your claim. Every care is taken to ensure that personal data is held securely. If your circumstances change at any time in future please inform us as soon as possible.

You authorise our panel solicitors to discuss any part of or disclose any information or documents relating to your claim to us. This will enable us to provide a more efficient service to all of our clients and customers.

We may on occasion send out emails to clients containing information we believe to be of interest. If you do not wish to receive these emails please contact us and you will be immediately removed from our mailing list. We do not condone or produce unsolicited email.


Limitation of Liability
The Accident Team shall not be liable for any loss or damage of any description whatsoever arising from the failure or delay in approval of any application or arising from any third party action.

Neither The Accident Team nor any of its employees, agents or other representatives will be liable for loss or damage arising out of or in connection with the use of this site. Our limitation of liability applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties howsoever caused. In particular and without prejudice to the generality of the foregoing The Accident Team will not be liable for any actions or failure to act on the part of any third party to whom you may be referred from this site

Nothing in these Terms and Conditions shall be contrued so as to exclude or limit the liability of The Accident Team for death or personal injury as a result of the negligence of The Accident Team or that of its emloyees, agents or other representative.

Indemnity
You agree to indemnify and keep indemnified The Accident Team and its employees, agents or other representative against any loss or damage arising from your unauthorised use of any part of the service provided by The Accident Team, and from all actions, proceedings, claims, demands, costs (including legal costs), awards and damages however they arise, directly or indirectly as a result of any breach or non-performance by you of any of your obligations under these terms and conditions or other liabilities arising out of the use of the Website.


Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the Law of England and Wales. You agree that any dispute connected with this agreement is subject to the exclusive jurisdiction of the English courts.

Should any clause or part of these Terms and Conditions be determined to be void, unenforceable or invalid, then that clause or part shall be severed from this agreement and the remaining Terms and Conditions will be in full force and effect and continue to be binding, provided that the basic nature of this agreement has not been changed by the severance.

Nothing in these Terms and Conditions affects your statutory rights.

Acceptance and change to Terms of Use
We reserve the right to change or vary these Terms and Conditions at any time due to legal or regularity reasons, or to reflect any updates or changes to The Accident Team services or functionality of the Website. We are under no obligation to inform you of any change to these Terms and Condition and your continued use of the Website and services provided by The Accident Team shall be deemed your acceptance to such change.
