Time Limits
You should seek legal advice and pursue your claim as soon as possible. There is a three-year time limitation allowed to commence Court proceedings or two-years if you are making a claim to the Criminal Injuries Compensation Authority.
If you were under 18 years of age at the time of your accident, the 3 year period does not start until your 18th birthday and Court proceeding can therefore be issued any time until your 21st birthday.
If you have suffered an illness at work, it may be that you don’t know until years, sometimes decades later. In cases of this sort, the three-year limitation period begins from the date you first realised that your illness was caused as a result of your work. This is known as your date of knowledge.
Exemptions
If a claim involves a person who has mental disability and who cannot manage their own affairs, the three-year limitation period does not apply.
There are exceptional circumstances where your claim may still be made outside the 3 year period. If this is the case with you, please contact us and we will see if we can help.
We recommend that you pursue your claim as soon as possible as witnesses are likely to more accurately remember what happened and more evidence will be available.
